1. GENERAL PROVISIONS

The electronic web store of NRGI, a limited partnership with its registered office in Halle, VAT BE 0665.686.056, (hereinafter “NRGI”) offers its customers the opportunity to purchase products online.
These Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this Website (“Customer”) with NRGI. Placing an order through NRGI’s web shop implies that the Customer has consulted these Terms and Conditions and expressly accepts the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the customer are excluded, except when accepted by NRGI in advance, in writing and expressly.

2. PRICE

All mentioned prices are expressed in EURO, always including VAT and all other taxes to be borne by the customer. If delivery, reservation or administrative fees are charged, this will be stated separately.

The statement of price refers only to the items as it is described verbatim. The accompanying photo is for decorative purposes and may include elements or items not included in the price

3. ADVERTISEMENT

Each offer is open only to customers residing in the European Union. The items are for normal private use only.

Despite the fact that the catalog and website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind NRGI. As far as the accuracy and completeness of the information offered is concerned, NRGI is only bound by an obligation of means. Under no circumstances shall NRGI be liable in case of material errors, misprints or printing errors.

The offer is always valid while supplies last and may be modified or withdrawn by NRGI at any time. NRGI cannot be held liable for the unavailability of any product.

4. ONLINE PURCHASES

The customer adds the chosen products to the basket and follows the online ordering procedure. Once the order is confirmed, NRGI receives the order. As soon as the order has been paid, or it has been communicated that payment will be made on the spot, NRGI will proceed with the agreed delivery method.

  • In Belgium: dispatch by B-post to address, postal point or automatic parcel machine
  • In the Netherlands and France : Shipping with B-post partner, to address or postal point
  • Outside Belgium: shipment to address via B-post, delivery by local postal company

The customer has the choice between the following payment methods:

by bank card

by bank transfer to account number

The purchase is established when the customer receives a confirmation email from NRGI.

Items will be delivered to the customer’s home at the delivery address indicated in the confirmation email.

NRGI shall have the right to refuse an order (in writing), pursuant to a serious breach by the customer in relation to the order or any other order or contract involving the customer.

5. RETENTION OF TITLE

The delivered items remain the exclusive property of NRGI until the moment of full payment by the customer.
However, the risk due to loss or damage shall pass to the customer as of delivery. The customer undertakes, if necessary, to point out NRGI’s retention of title to third parties, for example, to anyone who would come to seize items that have not yet been paid for in full.

6. PENALTIES FOR NON-PAYMENT

Without prejudice to the exercise of other rights available to NRGI, in the event of non-payment or late payment, the Customer shall be liable, as of the date of the default, ipso jure and without formal notice, for interest at 10% per annum on the unpaid amount. In addition, the customer shall be liable by operation of law and without notice to pay a fixed indemnity of 10% on the amount in question, with a minimum of 25 euros per invoice.

Notwithstanding the foregoing, NRGI reserves the right to take back items not paid for (in full).

7. DELIVERY

Items, after receipt of payment, are packaged and delivered via b-post, only in Belgium. Shipping is within 24 HOURS, barring stock breakage.

A shipping cost will be charged. For foreign countries, the rates apply depending on the country.

Any visible damage and/or qualitative deficiency of an item or other delivery failure, must be reported within 24 hours via email to info@bioparanrgi.com with photos as evidence.

8. RIGHT OF WITHDRAWAL

The consumer has the right to notify NRGI that he renounces the purchase, without payment of any penalty and without giving any reason within 14 days from the day following the delivery of the product.
Customers wishing to exercise the right of withdrawal must contact NRGI customer service within 14 days from delivery and return the goods within 20 days from delivery of the goods at their expense to NRGI gvc, POSTBUS 1 – 1440 BRAINE-LE-CHATEAU

The customer may not use the products during the withdrawal period. If the returned product is damaged or somehow diminished in value, NRGI reserves the right to claim compensation for any diminution in value due to the Customer.

Only items in their original packaging, along with all accessories, instructions for use and invoice or proof of purchase can be taken back.

Unless otherwise agreed, the customer cannot exercise the right of withdrawal for contracts :
1° concerning the delivery of services whose performance has begun with the customer’s consent before the end of the withdrawal period;
2° concerning the delivery of goods manufactured according to the customer’s specifications or which have a clearly personal character or which by their nature cannot be returned or are liable to deteriorate or age rapidly;
3° concerning the delivery of products whose seals have been broken by the customer; and or damaged.

9. PRIVACY

The data controller, NRGI, respects the General Data Protection Regulation (GDPR) of May 25, 2018 regarding the protection of privacy in the processing of personal data.
The personal data provided by you will only be used for the following purposes:

  • Sending emails with promotions and actions (only if you have given explicit consent)
  • Processing and sending orders and related confirmation emails
  • Internal follow-up regarding marketing and after-sales service

You have a legal right to inspect and possibly correct your personal data. Provided proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to NRGI, Nijvelsesteenweg 351, 1500 Halle, info@bioparanrgi.com. If necessary, you can also ask to correct the data that would be incorrect, incomplete or not pertinent.

The customer is responsible for keeping his log-in data confidential and the use of his password. Your password is stored encrypted, so NRGI does not have access to your password.

10. USE OF COOKIES

Failure at any time by NRGI to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

13. MODIFICATION OF TERMS AND CONDITIONS

These Terms are supplemented by other terms and conditions expressly referred to, and NRGI’s general terms and conditions of sale. In case of contradiction, these Terms take precedence.

NRGI may change these Terms at any time without further notice. Any purchase after the change, constitutes an acceptance by the customer of these new Terms and Conditions.

14. PROOF

The customer accepts that electronic communications and backups may serve as evidence.

15. APPLICABLE LAW – COMPETENT COURT

Belgian law is applicable, with the exception of the provisions of international private law on applicable law and with of the Rome I Regulation on international sales contracts relating to movable property. In the event of any disputes, the courts of Brussels shall have exclusive jurisdiction.
